Terms of Use

Introduction

These Terms of Use govern access to and use of the That Reminds Me Platform. They establish the framework within which the Platform is made available and define the rights and responsibilities of That Reminds Me and those who access or use its Services.

These Terms apply to all users of the Platform and should be read together with the Privacy Policy, the Story Page Agreement (where applicable), and any other policies or agreements expressly incorporated by reference.

By accessing or using the Platform, users acknowledge that they have read these Terms and agree to be bound by them.

Definitions

These Terms use certain words and expressions in a specific sense to promote clarity, consistency and a shared understanding of the relationship between That Reminds Me and its Users. Unless the context indicates otherwise, the following terms have the meanings set out below.

Contributor means a User who submits Story Content to a Story Page.

Platform means the That Reminds Me digital platform, website and associated Services made available from time to time.

Privacy Policy means the privacy policy published by That Reminds Me, as amended from time to time.

Services means the services, functionality and features made available through the Platform from time to time.

Story Content means any text, photograph, image, audio recording, video, document, tribute, memory or other material submitted to or made available through a Story Page.

Story Page means a digital page created through the Platform for the preservation, sharing and stewardship of stories, memories and related content.

Story Page Agreement means the agreement entered into between That Reminds Me and a Story Page Custodian governing the creation, administration and stewardship of a Story Page.

Story Page Custodian means the User responsible for the creation, administration and stewardship of a Story Page in accordance with the relevant Story Page Agreement.

User means any person who accesses or uses the Platform or its Services, whether as a visitor, account holder, Contributor or Story Page Custodian.

User Account means an account established by a User to access those Services that require registration.

The Definitions establish a common language for these Terms. The sections that follow explain the nature of the Platform and the principles that govern its use with reference to those shared meanings.

Nature of the Platform

That Reminds Me provides a platform dedicated to the preservation, stewardship and intentional sharing of meaningful human stories. The Platform has been designed to support Story Pages that commemorate lives, relationships, achievements and memories within a framework of dignity, authenticity and respect.

The Platform is not intended to function as an unrestricted public forum or social media service. Its features, governance framework and community standards reflect its purpose of preserving stories responsibly while respecting the rights, privacy and legitimate interests of all persons connected with those stories.

Scope

These Terms apply to all persons who access, browse or otherwise use the Platform, whether or not they have created an account or established a Story Page. They govern all use of the Platform and its Services, except where a separate agreement expressly provides otherwise.

Accordingly, these Terms apply to:

1. visitors who access or browse the Platform;
2. registered Users who create or maintain an account;
3. Story Page Custodians who establish, administer or manage Story Pages;
4. Contributors who submit Story Content or otherwise participate in Story Pages;
5. any person who communicates with That Reminds Me through the Platform or in connection with its Services; and
6. any other individual or organisation that accesses or uses the Platform or its Services.

Where a User enters into a separate agreement with That Reminds Me, including a Story Page Agreement, the provisions of that agreement will apply in addition to these Terms. To the extent of any inconsistency, the specific agreement will prevail in relation to the subject matter it governs.

Access to the Platform

That Reminds Me seeks to make the Platform accessible to individuals, families and communities wishing to preserve and share meaningful human stories responsibly. Access to the Platform is granted subject to these Terms and to any reasonable measures necessary to protect the integrity, security and proper operation of the Platform.

Accordingly:

1. any person may access those areas of the Platform made available for public use, subject to these Terms;
2. certain features or Services may require a User to register an account or provide information reasonably necessary to verify their identity or facilitate the proper administration of the Platform;
3. access to, and administration of, a Story Page is governed by the applicable Story Page Agreement, which establishes the specific rights and responsibilities of the Story Page Custodian and, where applicable, Contributors;
4. where a User enters into a separate agreement with That Reminds Me in relation to particular Services or activities, including the creation or administration of a Story Page, those agreements will apply in addition to these Terms and should be read together with them;
5. Users are responsible for ensuring that any information provided in connection with their access to the Platform is accurate, complete and kept reasonably up to date; and
6. That Reminds Me may suspend, restrict or refuse access to the Platform where reasonably necessary to protect the security, integrity or lawful operation of the Platform, or where required by applicable law.

Access to the Platform is the beginning of participation in a community founded upon dignity, authenticity and responsible stewardship. These Terms are intended not to restrict responsible participation, but to establish a framework within which all Users may engage with the Platform confidently, respectfully and in a manner consistent with its purpose. The provisions that follow describe the standards of conduct that support that shared commitment.

Participation in the Platform

That Reminds Me has been created to encourage meaningful participation in the preservation and sharing of human stories. Participation may take many forms, including visiting Story Pages, contributing memories or tributes, creating an account, or assuming responsibility for the stewardship of a Story Page. While the manner in which individuals participate may differ, all participation is founded upon the shared values of respect, authenticity, responsibility and consideration for others.

The provisions that follow establish the standards and responsibilities applicable to different forms of participation, ensuring that the Platform remains a trusted environment for everyone who engages with it.

Acceptable Use

That Reminds Me exists to preserve and celebrate meaningful human stories within an environment founded upon trust, dignity and mutual respect. Every person who participates in the Platform contributes to maintaining that environment, whether by visiting a Story Page, sharing a memory, contributing content, or assuming responsibility for its stewardship.

The standards set out in this section are intended not merely to regulate conduct, but to safeguard the integrity of the Platform and the interests of everyone who participates in it. They establish the terms upon which Users engage with the Platform and with one another, ensuring that the Platform remains a respectful, secure and trustworthy place in which stories may be shared and preserved.

In participating in the Platform, Users must not:

1. use the Platform for any unlawful, fraudulent or improper purpose;
2. publish, upload or transmit any content that is false, misleading, defamatory, abusive, threatening, discriminatory, hateful, obscene or otherwise unlawful;
3. infringe the intellectual property, privacy or other lawful rights of any person;
4. interfere with, disrupt or compromise the security, functionality or proper operation of the Platform;
5. attempt to gain unauthorised access to any account, Story Page, system or data;
6. introduce malicious software, viruses or other harmful code into the Platform;
7. impersonate another person or misrepresent their identity, authority or relationship with any individual or organisation;
8. use the Platform in any manner that is inconsistent with these Terms or that may reasonably be expected to undermine the purpose, integrity or reputation of That Reminds Me.

The standards set out in this section are intended to protect not only the Platform, but also the people whose stories it exists to preserve. As Users choose to participate more fully in the Platform, additional rights and responsibilities may arise through the creation and use of a User Account.

User Accounts

Many features of the Platform may be enjoyed without registration. However, certain Services and forms of participation require Users to establish and maintain a User Account.

Where a User Account is required:

1. Users must provide accurate and complete registration information;
2. Users are responsible for maintaining the confidentiality of their account credentials and for all activity conducted through their account;
3. Users must notify That Reminds Me promptly if they become aware of any unauthorised access to or use of their account;
4. That Reminds Me may suspend or terminate a User Account in accordance with these Terms where reasonably necessary to protect the Platform or its Users.

Where a User Account is established for the purpose of creating, administering or stewarding a Story Page, the rights and responsibilities associated with that role are governed by the applicable Story Page Agreement, which should be read together with these Terms.

Story Pages

Story Pages are the heart of the That Reminds Me Platform. They provide the digital spaces through which stories, memories and tributes may be preserved, shared and stewarded across generations. Some Story Pages may be publicly accessible, while others may be shared only with those authorised by the Story Page Custodian.

The Platform supports different forms of participation in relation to Story Pages. Visitors may browse, read and, where permitted, contribute to Story Pages. Story Page Custodians are entrusted with additional responsibilities for the creation, administration and stewardship of those pages, which are governed by the applicable Story Page Agreement.

Creation and Administration of Story Pages

Story Pages provide the means through which individuals, families and communities may preserve, share and steward meaningful human stories. Each Story Page represents a unique digital space entrusted to its Story Page Custodian, who assumes responsibility for its creation, administration and ongoing stewardship in accordance with these Terms and the applicable Story Page Agreement.

While visitors and Contributors may participate in Story Pages in accordance with the permissions established by the Story Page Custodian, the stewardship of each Story Page remains subject to the responsibilities accepted by the Custodian under the Story Page Agreement.

Accordingly, the creation and administration of Story Pages are subject to the following principles:

1. Story Pages may be created only by Users who have established a User Account and accepted the applicable Story Page Agreement.
2. Each Story Page must identify a Story Page Custodian who is responsible for its administration and for exercising the rights and responsibilities associated with that role.
3. A Story Page Custodian may determine the manner in which a Story Page is presented and administered, including the management of content, visitor participation and access permissions, subject always to these Terms, the Story Page Agreement and any applicable law.
4. A Story Page Custodian may authorise other persons to participate in the administration, development or stewardship of a Story Page in accordance with the functionality made available through the Platform and the applicable Story Page Agreement.
5. The rights and responsibilities associated with the creation, administration and stewardship of Story Pages are governed in greater detail by the Story Page Agreement, which forms an integral part of the governance framework applicable to Story Page Custodians.

The creation of a Story Page marks the beginning of its stewardship rather than its completion. The Platform therefore provides a framework within which Story Pages may be accessed, shared and contributed to responsibly, balancing meaningful participation with the rights, wishes and responsibilities of those entrusted with their stewardship.

Access to Story Pages

That Reminds Me enables Story Pages to be shared in ways that reflect the wishes of the Story Page Custodian and the purpose for which the Story Page has been established. While the Platform provides the means by which Story Pages may be accessed, the level of access available to visitors is determined by the settings and permissions made available through the Platform and exercised by the Story Page Custodian in accordance with these Terms and the applicable Story Page Agreement.

Subject to the functionality made available by the Platform:

1. a Story Page may be publicly accessible;
2. access may be restricted to invited or authorised persons;
3. access may require a password, invitation, QR code or other authentication method;
4. different categories of visitors may be granted different levels of participation or contribution;
5. the Story Page Custodian may modify access permissions from time to time, subject to these Terms and the capabilities of the Platform.

The creation of a Story Page establishes the framework within which that story may be preserved and shared through the Platform. As participation grows, the manner in which others may access, contribute to and engage with a Story Page will depend upon the services and functionality made available by the Platform and the stewardship exercised by the Story Page Custodian in accordance with these Terms and the applicable Story Page Agreement.

Contributions and Participation

Story Pages are intended to encourage meaningful participation by those whose memories, experiences and relationships enrich the stories they preserve. The Platform therefore supports visitors and invited participants, where appropriate, in contributing memories, tributes and other Story Content in ways that support the integrity of each Story Page and respect the wishes of the Story Page Custodian.

The manner in which contributions may be made will depend upon the services and functionality made available by the Platform, the permissions established by the Story Page Custodian, and these Terms of Use.

The following provisions give practical effect to these principles by establishing the rights, responsibilities and standards that govern participation in Story Pages.

1. Visitors and authorised participants may, where the services and functionality of the Platform permit, contribute memories, tributes, photographs, recordings or other Story Content to a Story Page in accordance with these Terms, the permissions established by the Story Page Custodian and any applicable Story Page Agreement.
2. Every person who contributes Story Content remains responsible for ensuring that their contribution is accurate to the best of their knowledge, respectful of others, and does not infringe the intellectual property, privacy or other lawful rights of any person.
3. By submitting Story Content, contributors grant That Reminds Me the limited rights reasonably necessary to host, display, preserve and make that content available through the Platform in accordance with these Terms, the applicable Story Page Agreement and the Privacy Policy.
4. Where the services and functionality of the Platform permit, the Story Page Custodian may review, organise, approve, edit or remove contributions to a Story Page in the exercise of their stewardship responsibilities and in accordance with these Terms and the applicable Story Page Agreement.
5. The Story Page Custodian may determine, within the capabilities of the Platform and subject to these Terms, the extent to which visitors and authorised participants may contribute to, interact with or otherwise participate in a Story Page.
6. That Reminds Me may remove, restrict access to or decline to publish any Story Content where it reasonably considers such action necessary to protect the integrity of the Platform, comply with applicable law, safeguard the rights or interests of any person, or enforce these Terms or any applicable agreement.
7. Nothing in this section limits the right of That Reminds Me to investigate alleged breaches of these Terms or to take such reasonable steps as may be necessary to preserve the security, integrity and proper operation of the Platform.

Meaningful participation contributes to the continuing life of a Story Page. The Platform therefore seeks to preserve those contributions responsibly while recognising that the availability of digital services depends upon evolving technologies, operational requirements and the continued stewardship of the Platform itself.

Availability and Preservation

Story Pages are intended to preserve meaningful human stories in a manner that supports continuity across time and generations. That Reminds Me is committed to maintaining the Platform responsibly and seeks to ensure that Story Pages remain accessible and secure. At the same time, Users acknowledge that the provision of digital services depends upon technology, infrastructure and circumstances that may change over time.

Accordingly, the following provisions give practical effect to these principles:

1. That Reminds Me will use reasonable care and skill in maintaining the availability, security and integrity of the Platform, but does not guarantee uninterrupted or error-free access to any Story Page or Service.
2. That Reminds Me may perform maintenance, upgrades, repairs or other operational activities that temporarily affect the availability of the Platform or particular Story Pages, and will seek to minimise disruption where reasonably practicable.
3. That Reminds Me may implement reasonable measures to safeguard Story Content, including backup, recovery and security procedures appropriate to the operation of the Platform. However, Users acknowledge that no digital storage or transmission system can be guaranteed to be completely secure or immune from failure.
4. As technology evolves, That Reminds Me may modify, replace or migrate the systems through which Story Pages are provided, provided that such changes are undertaken with due regard to preserving the continuity and integrity of Story Pages wherever reasonably practicable.
5. Nothing in this section prevents That Reminds Me from suspending or restricting access to the Platform where reasonably necessary to protect its security, comply with applicable law or maintain the proper operation of its Services.

The preservation of stories depends not only upon the care with which they are created, but also upon the responsible stewardship of the Platform through which they are shared. These provisions are intended to support that stewardship while recognising the practical realities of maintaining a secure and evolving digital service.

Changes and Transitions

While Story Pages are created with continuity in mind, circumstances may change over time. This section explains how That Reminds Me manages requests and situations that affect an existing Story Page, balancing the wishes of the Story Page Custodian with the Platform’s operational, legal and governance responsibilities.

The following provisions give practical effect to these principles by establishing the framework within which changes affecting Story Pages are managed, including amendments, requests for closure and other circumstances that may require action by That Reminds Me.

1. A Story Page Custodian may request the correction or removal of Story Content, or such other amendments as may be supported by the services and functionality made available by the Platform, in accordance with these Terms and the applicable Story Page Agreement.
2. Where a Story Page is amended at the request of the Story Page Custodian, that Reminds Me may make those revisions without additional charge. However, such adjustments do not entitle the Story Page Custodian to any refund, credit or partial reimbursement of fees previously paid.
3. A Story Page Custodian may request that a Story Page be brought to a close. Where appropriate and reasonably practicable, this may include removing the Story Page or its content from public access, subject to these Terms, any applicable law and the operational requirements of the Platform.
4. That Reminds Me may suspend, restrict or bring a Story Page to a close where reasonably necessary to enforce these Terms, comply with applicable law, protect the rights or interests of any person, or preserve the security, integrity and proper operation of the Platform.
5. Notwithstanding any request for closure or removal, That Reminds Me may retain information where reasonably necessary to comply with applicable law, resolve disputes, protect lawful rights or fulfil legitimate operational, archival or legal requirements.

The Platform exists to preserve stories with dignity and respect, recognising that those stories form part of people’s lives and relationships. When circumstances change, That Reminds Me seeks to manage those changes thoughtfully, balancing the wishes of the Story Page Custodian with its responsibilities to maintain the integrity of the Platform and to comply with its legal and governance obligations.

Intellectual Property

That Reminds Me respects the intellectual property and personal interests associated with the stories, photographs, recordings and other material shared through the Platform. Unless expressly stated otherwise, contributors retain ownership of the intellectual property they create. The rights granted to That Reminds Me are limited to those reasonably necessary to provide, operate, maintain and improve the Platform in accordance with these Terms.

The following provisions give practical effect to these principles.

1. The Platform, including its name, branding, logos, software, design, layout, text, graphics and other proprietary material, is owned by or licensed to That Reminds Me and is protected by applicable intellectual property laws.
2. Ownership of Story Content remains with the person or persons who own the applicable intellectual property or other lawful rights in that content. Nothing in these Terms transfers ownership of Story Content to That Reminds Me.
3. By submitting Story Content to the Platform, the Story Page Custodian or other authorised contributor grants That Reminds Me a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and otherwise use that Story Content solely to the extent reasonably necessary to provide, maintain, preserve and operate the Platform and its Services.
4. Users are responsible for ensuring that they have the necessary rights, permissions or authority to submit Story Content and that doing so does not infringe the intellectual property or other lawful rights of any person.
5. Where That Reminds Me reasonably believes that Story Content infringes the rights of another person or otherwise breaches these Terms, it may restrict access to, remove or otherwise deal with that content in accordance with its governance procedures and applicable law.

The purpose of these provisions is not to diminish the rights of those who contribute to Story Pages, but to ensure that stories can be preserved, shared and protected responsibly. That Reminds Me seeks to respect both the creative contributions of individuals and the legal rights that attach to them.

Privacy and Personal Information

That Reminds Me recognises that Story Pages often contain personal information, memories and other material of significant personal and family importance. The Platform is committed to handling personal information responsibly, lawfully and with appropriate respect for the dignity and privacy of those whose stories are shared.

The collection, use, storage and protection of personal information are governed by these Terms and the applicable Privacy Policy, which forms an integral part of the relationship between Users and That Reminds Me. The following provisions give practical effect to these principles.

1. That Reminds Me may collect and process personal information reasonably necessary to establish, operate, maintain and improve the Platform and its Services, in accordance with its Privacy Policy and applicable law.
2. Users are responsible for ensuring that they have the necessary authority, consent or other lawful basis, where required, to provide personal information relating to other individuals through the Platform.
3. Users should take reasonable care to ensure that personal information they provide is accurate and, where appropriate, kept up to date.
4. That Reminds Me will take reasonable technical and organisational measures to safeguard personal information against unauthorised access, loss, misuse or disclosure, recognising that no electronic system can guarantee absolute security.
5. Further information regarding the collection, use, storage, disclosure and protection of personal information, together with the rights available to data subjects, is set out in the Privacy Policy, which should be read together with these Terms.

Respect for privacy is fundamental to the trust upon which That Reminds Me is built. These provisions seek to balance the preservation and sharing of meaningful stories with the rights and dignity of every individual whose personal information forms part of those stories.

Limitation of Liability

That Reminds Me seeks to provide a reliable and respectful platform for the preservation and sharing of meaningful stories. While the Platform is operated with reasonable care and diligence, Users acknowledge that digital services have practical limitations and that responsibility for the use of the Platform is shared between That Reminds Me and its Users.

The following provisions establish the extent of That Reminds Me’s responsibility in relation to the Platform and its Services.

1. That Reminds Me will exercise reasonable care and skill in providing and maintaining the Platform and its Services but does not warrant that the Platform will always be available, uninterrupted, error-free or free from security risks beyond its reasonable control.
2. Story Content is created and contributed by Story Page Custodians and other authorised contributors. Unless expressly stated otherwise, That Reminds Me does not verify the accuracy, completeness or authenticity of Story Content and is not responsible for opinions, memories or factual assertions made by Users.
3. To the fullest extent permitted by applicable law, That Reminds Me is not liable for indirect, incidental, consequential or special loss arising from the use of, or inability to use, the Platform or its Services.
4. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
5. Users remain responsible for the decisions they make regarding the creation, management and sharing of Story Pages and for ensuring that their use of the Platform complies with these Terms and applicable law.

These provisions are intended to establish a fair allocation of responsibility between That Reminds Me and its Users. They do not diminish the Platform’s commitment to preserving stories with care and respect, but recognise that no digital service can assume responsibility for every circumstance arising from the creation and sharing of personal stories.

Indemnity

That Reminds Me seeks to provide a trusted platform through which stories may be preserved and shared responsibly. Where a User’s breach of these Terms causes That Reminds Me to incur loss or liability, fairness requires that the resulting consequences should be borne by that User.

The following provisions give practical effect to these principles.

1. Users are responsible for ensuring that their use of the Platform and any Story Content they submit complies with these Terms, the relevant Story Page Agreement and applicable law.
2. Subject to applicable law, a User agrees to indemnify That Reminds Me against any reasonable loss, liability, damage, cost or expense (including reasonable legal costs) incurred by That Reminds Me as a direct result of the User’s breach of these Terms.

These provisions are intended to allocate responsibility fairly between That Reminds Me and its Users and do not limit any rights or remedies available under applicable law.

Changes to these Terms

These Terms may be updated from time to time to reflect changes to the Platform, its services, legal requirements or operational practices. Where changes are made, That Reminds Me will publish the updated Terms on the Platform.

The following provisions explain how changes take effect.

1. Updated Terms become effective when published (or on a stated effective date).
2. Continued use after that date constitutes acceptance.
3. Where changes materially affect existing Story Page Agreements, That Reminds Me may notify affected Story Page Custodians directly where reasonably practicable.

These arrangements are intended to ensure that Users remain informed while allowing the Platform to evolve responsibly.

Governing Law

These Terms are governed by the laws of England and Wales and are intended to provide a clear legal framework for the relationship between That Reminds Me and its Users.

The following provisions give practical effect to these principles.

1. These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
2. The courts of England and Wales shall have jurisdiction in relation to any dispute arising from or connected with these Terms, subject to any rights that a User may have under mandatory consumer protection laws applicable to them.

Nothing in this section affects any rights that cannot lawfully be excluded under applicable law.

General Provisions

These Terms are intended to provide a clear and practical framework for the use of the Platform.

The following general provisions support the continued interpretation and operation of these Terms.

1. If any provision of these Terms is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall, to the extent necessary, be treated as severed from these Terms without affecting the validity or enforceability of the remaining provisions.
2. Any failure or delay by That Reminds Me in exercising a right or remedy under these Terms shall not constitute a waiver of that right or remedy.
3. Questions about these Terms or the use of the Platform may be directed to That Reminds Me using the contact details published on the Platform.
